In the following article, the opinions of jurisprudence scholars and the views of jurists have been examined by using library sources and descriptive-analytical method. The results of the research show that the jurists consider istiṣḥāb to be valid in this issue, but due to the conflict, they do not consider any effect for it and refer to the principles of taṭhīr (purification), casting of lots, discretion, etc. Of course, some have totally considered istiṣḥāb to be invalid and brought up the authenticity of taṭhīr. By differing on the proceeding of istiṣḥāb, the jurists have not differentiated the quality and type of. Jurists have accepted the opinion of jurists regarding the assumption of ignorance at the time of the first incident, but they have different opinions regarding the assumption of ignorance at the time of the second incident. In this article, the defects of Article 873 of the Civil Code, which are in clear opposition to jurisprudence, have been examined. As one of the results of this research, and considering that Iran’s Civil Code is derived from Imāmī jurisprudence, it seems that the content of Iran’s Civil Code should undergo a revision on the issue of inheritance. Many differences between “Iran’s Civil Code” and “Imāmī jurisprudence” have led to arising differences in issues such as inheritance}, keywords = {istiṣḥāb,known date and unknown date,priority and posteriority of incidents,Shī’a jurisprudence,Article 873 of Iran’s Civil Code}, title_fa = {اعتبارسنجی استصحاب در دو امر حادث با تاریخ مجهول؛ و تأثیر آن در نقد ماده 873 قانون مدنی}, abstract_fa = {جریان و یا عدم جریان استصحاب در دو حادثه‌ای که تقدم و تأخر آن دو مشخص نیست، دارای ثمرات فقهی و حقوقی فراوانی در بیشتر ابواب فقه و حقوق می‌باشد و اندیشمندان فقه و حقوق در این مسئله دیدگاه‌های مختلفی ابراز داشته‌اند. در نوشتار پیش‌رو با بهره‌گیری از منابع کتابخانه‎‌ای و با روش تحلیلِ تطبیقی، آراء دانشمندان فقه و دیدگاه حقوقدانان مورد بررسی قرار گرفته است. نتایج پژوهش نشان می‌دهد که فقها استصحاب را در این مسأله جاری دانسته، ولی به سبب تعارض، اثری برای آن لحاظ نمى‏کنند و به قاعده طهارت، قرعه، احتیاط و .... مراجعه می‌کنند. البته برخی به کلی استصحاب را جاری ندانسته و اصالت طهارت‌‏را مطرح نموده‌اند. فقها با اختلاف در جریان استصحاب، در کیفیت و نوع جهل تفاوت قائل نشده‌اند. حقوقدانان در فرض جهل در زمان حادثه نخست دیدگاه فقیهان را پذیرفته‌اند، ولی در فرض جهل در زمان حادثه دوم، آراء مختلفی دارند. در این مقاله اشکالات ماده 873 قانون مدنی که مخالفت صریح با فقه دارد بررسی شده است. به عنوان یکی از نتایج این پژوهش، و ملاحظه این‌که قانون مدنی ایران، بر گرفته از فقه امامیّه می‌باشد، به نظر می رسد بایستی در محتوا قانون مدنی ایران در موضوع ارث بازنگری صورت گیرد. تفاوت‌های بسیار میان «قانون مدنی ایران» و «فقه امامیّ» منجر به بروز اختلافاتی در مسائلی چون ارث شده است.}, keywords_fa = {استصحاب,معلوم التاریخ و مجهول التاریخ,تقدم و تأخر حادثین,فقه شیعه,ماده 873 قانون ‏مدنی.‏}, url = {https://mfu.uok.ac.ir/article_62406.html}, eprint = {https://mfu.uok.ac.ir/article_62406_a6cb9ada54873c92b72e375dd8af9484.pdf} }
