Generally, one culture as an official and dominant culture is supported by the central government and recognized. Such an approach results the discontent of other cultural groups. Different groups who are in such a situation, often claim their rights by human rights literature or minority rights. A number of theorists have proposed an “equal citizen” theory to solve this problem. The other ones also, have provided a solution to claim the rights of cultural groups and minority by presentation the theory of a “different citizenship’’ or “multicultural citizenship’’ and sometimes ‘’tended multicultural’’ in the area of minority rights and citizen rights. Among these theories, the theories of thinkers such as Will Kymlicka and Irish Marion Yang are significant. .Qur’anic verses and Islamic law sources have special rules hereof, and they seem to confirm the approach of a different citizen with equal citizen. This article seeks to challenge the classical theories of citizenship rights on the basis of "equal citizen" and on the basis of the theory of "multicultural citizenship" and "different citizens" of the abovementioned scholars and a number of Qur’anic verses and affected by the aforementioned theory, provides a new framework for claiming minority rights and solving their problems in countries with mosaics of ethnic, national, cultural and different identities. And seeks to provide a model that is consistent with and compatible with multicultural countries to peaceful living with admission of different the other one.}, keywords = {Keywords: Minority rights,Citizenship rights,Multiculturalism,Different citizen,Cultural diversity}, title_fa = {حمایت از حقوق اقلیت‌ها با توسل به رهیافت شهروندی چندفرهنگی}, abstract_fa = {در جهان کمتر دولتی را می‌توان یافت که دارای ساخت تک فرهنگی باشد و در بیشتر موارد یک فرهنگ به عنوان فرهنگ غالب و رسمی در این دولت‌ها از جانب حکومت مرکزی مورد حمایت بوده و رسمیت می‌یابد. چنین رویکردی به نارضایتی گروه‌های فرهنگی مختلف در این ساختهای تک فرهنگی رسمی انجامیده است. گروه‌های مختلفی که در این وضعیت قرار گرفته‌اند اغلب با توسل به ادبیات حقوق بشری و یا حقوق اقلیت‌ها به مطالبه حقوق خود می‌پردازند. تعدادی از نظریه پردازان برای حل این مشکل نظریه «شهروند برابر» را ارائه کرده‌اند. در این میان تعدادی نیز با ارائه نظریه «شهروندی متفاوت» و یا «شهروندی چند فرهنگی» و گاهی نیز «چندفرهنگ گرایی» در حوزه حقوق اقلیت‌ها و حقوق شهروندی به ارائه راهکاری برای مطالبه حقوق گروه‌های فرهنگی و اقلیت‌ها پرداخته‌اند. در این میان نظریات اندیشمندانی مانند ویل کیملیکا و ایریس ماریون یانگ حائز اهمیت و توجه ویژه است. آیات قرانی و منابع حقوق اسلامی نیز در این راستا دارای مقررات ویژه‌ای بوده و به نظر می‌رسد رویکرد شهروند متفاوت را در کنار شهروند برابر مورد تأیید قرار می‌دهند. این مقاله با به چالش کشیدن نظریه‌های کلاسیک حقوق شهروندی و «شهروند برابر» در پرتو نظریه «شهروندی چندفرهنگی» و «شهروند متفاوت» اندیشمندان فوق‌الذکر و تعدادی از آیات قرآن کریم، به ارائه چهارچوبی نو برای مطالبه حقوق اقلیت‌ها و حل مشکل آنان در کشورهای دارای موزاییک اقوام، ملیتها، فرهنگ‌ها و هویت‌های متفاوت تحت عنوان هر گونه گروه اقلیتی می‌پردازد و درصدد ارایه‌ی مدلی موافق و هم‌خوان با کشورهای چند فرهنگی جهت زندگی.}, keywords_fa = {واژگان کلیدی: حقوق اقلیت‌ها,حقوق شهروندی,چند فرهنگ گرایی,شهروند متفاوت,تنوع فرهنگی}, url = {https://mfu.uok.ac.ir/article_61031.html}, eprint = {https://mfu.uok.ac.ir/article_61031_c759989d49e870ff1ab18e553ca5553a.pdf} }
